automatically on completion of minimum length of service but had to be declared suitable for promotion based on
applicable criteria - Fact that appellant was punished for misconduct formed part of his service record which was rightly
taken into consideration whilst adjudging his suitability on criteria of seniority-cum-merit - Based on his misconduct if
appellant was not promoted, it cannot be said to be by way of punishment - Impugned judgment finding that non-
