LLM Notes: Amnesty International's Recommendations to Government of India

 


Amnesty International issued a comprehensive six-point human rights charter in June 2024 addressing systematic violations in India.

1. Repeal Discriminatory Laws: Repeal the Citizenship (Amendment) Act 2019, anti-conversion laws, and anti-hijab bans; impose a moratorium on demolitions targeting marginalized communities, particularly Muslims.

2. Protect Dalits and Indigenous Peoples: Ensure impartial investigations into mob lynchings, ethnic violence in Manipur, and gender-based violence; prosecute perpetrators including government officials responsible for violence.

3. Safeguard Civil Liberties: Immediately release human rights defenders and journalists arrested under the Unlawful Activities (Prevention) Act (UAPA); amend or repeal UAPA; reform the Foreign Contribution (Regulation) Act (FCRA) to prevent political suppression of NGOs.

4. Protect Right to Privacy: End internet shutdowns; repeal Information Technology Rules 2021 and 2023 amendments; conduct transparent investigation into Pegasus spyware misuse against journalists and activists.

5. Ensure Institutional Independence: Make the National Human Rights Commission (NHRC) independent from political appointments and ensure implementation of its recommendations.

6. Enforce Corporate Accountability: Implement human rights due diligence by companies; strengthen labour laws on pay equity, anti-discrimination, and worker rights; ratify ILO Conventions 87 and 98.

These recommendations align with India's obligations under the International Covenant on Civil and Political Rights (ICCPR) and India's constitutional provisions.
