Thus, the right of the petitioner being a tenant in common qua the landlord has not been adjudicated; therefore, the tenancy remains alive. It is settled law that the tenancy cannot be terminated in piecemeal. The rights of the petitioner as a tenant in common need to be adjudicated for the effective termination of the tenancy.
